Terms of Service & Public Offer

1. The service

Chertila is a software-as-a-service product that converts a written brief into an animated infographic, lets users edit scenes, render the result to MP4 or WebM, and store generated animations in their account.

The product is digital. There is no physical delivery. Access is provided online through a web app at the service domain.

2. Account & eligibility

• An account is required to use the editor and paid subscriptions.
• You are responsible for keeping your account credentials, generated assets, and saved style kits secure.
• You must have the right to upload any reference images, prompts, or other content used to generate animations.
• The service is intended for users of legal age in their jurisdiction and for lawful business or personal use.

3. Subscriptions & credits

• Plans are monthly subscriptions that grant a fixed number of animation credits per month, as listed on the Pricing page.
• One animation generation or edit consumes credits according to its complexity and rendering options.
• Subscriptions renew every 30 days until cancelled.
• You may cancel future renewals from the billing page. The current paid period remains available until it ends.
• A 7-day free trial may be available once per user. To set up a trial in RUB we may use a YooKassa 1 RUB authorization that is reversed once the payment method is linked.

4. Payment

• RUB payments are processed by YooKassa.
• USD payments are processed by LemonSqueezy.
• The currency you choose determines the payment provider automatically. Payment method availability depends on the provider, country, bank, and selected method.
• We do not store full payment credentials. Payment details are entered on the provider's payment page.

5. Refunds

• You may request a refund within 14 days of payment if a technical issue prevents you from accessing the paid digital service and we are unable to resolve it within a reasonable time.
• Refunds are not granted for credits that have been substantially used or for periods during which the service was successfully delivered.
• To request a refund, email olegstefanoyv1@gmail.com with the account email, payment date, amount, currency, and a description of the issue.
• Approved refunds are returned to the original payment method via the original payment provider, typically within 5-10 business days after approval.

6. Acceptable use

• You may not use the service for unlawful activity, harassment, spam, fraud, generation of disallowed sexual content involving minors, hateful or violent content prohibited by applicable law, or content that infringes intellectual property rights.
• Do not upload reference material or prompts you do not have the right to use.
• AI-generated output may be inaccurate. You are responsible for reviewing animations before publishing or sharing them.
• We may suspend or terminate access if usage creates legal, payment, security, or abuse risk for the service or other users.

7. Intellectual property & content

• The Chertila software, branding, default style kits, and documentation belong to us or our licensors.
• You retain ownership of the prompts, custom style kits, and animations you generate, subject to the terms of any third-party model providers.
• You grant us a limited right to store, process, and display your content as required to operate the service.
• Personal data handling is described in the Privacy Policy.

8. Availability & limitation of liability

• The service is provided on an as-available basis. We work to keep it stable but do not guarantee uninterrupted availability.
• To the maximum extent permitted by law, we are not liable for indirect damages, lost profits, lost data, or decisions taken on the basis of AI-generated output.
• Aggregate liability is limited to the amount you paid for the service in the 30 days preceding the event giving rise to the claim.

9. Changes

We may update these terms when the service, payment process, applicable law, or provider rules change. The current version is always published on this page.
